2. Service Description

TradeJour.nl is an AI-powered tool that:

• Extracts trading data from TradingView screenshots using OCR and AI
• Generates trade summaries and insights
• Helps traders maintain backtesting journals
• Provides trade analysis and organization tools

The Service is provided "as is" and we make no guarantees about OCR accuracy, AI analysis quality, or service availability.

3. User Accounts

3.1 Account Creation

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not share your account with others

3.2 Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree NOT to:

• Upload malicious files, viruses, or harmful code
• Attempt to bypass usage limits or access controls

• Reverse engineer or decompile the Service
• Use the Service for illegal or fraudulent purposes
• Violate intellectual property rights

5. Subscription Tiers and Pricing

5.1 Tier Limits

The Service offers the following tiers:

• Free - 10 screenshot uploads per month
• Starter - 100 screenshot uploads per month
• Pro - Unlimited screenshot uploads

5.2 Payments

Paid subscriptions are billed monthly. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.3 Refunds

Refunds are handled on a case-by-case basis. Please contact support if you believe you are entitled to a refund.

5.4 Cancellation

You may cancel your subscription at any time. Your access will continue until the end of the current billing period.

6. Intellectual Property

6.1 Your Content

You retain all rights to the screenshots, notes, and data you upload ("Your Content"). By using the Service, you grant us a limited license to:

• Store, process, and display Your Content
• Use OCR and AI to analyze Your Content
• Generate trade summaries and insights
• Make publicly shared trades accessible to others

6.2 Our Content

The Service, including its code, design, and features, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

7. AI and OCR Disclaimers

The Service uses AI and OCR technologies to extract and analyze trading data. You acknowledge that:

• OCR accuracy may vary depending on screenshot quality
• AI-generated summaries may contain errors or inaccuracies
• You are responsible for verifying all extracted data before saving
• We are not liable for trading decisions based on AI analysis
• The Service is for educational and journaling purposes only

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or availability of the Service
• Uninterrupted or error-free operation
• Security or freedom from viruses

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Trading losses based on Service usage
• Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

11. Data and Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

12. Termination

You may terminate your account at any time through your settings page. Upon termination:

• Your access to the Service will end immediately
• All your data will be deleted within 30 days
• We are not obligated to refund any fees

These Terms shall be governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
